Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Manga Translator (“Manga Translator,” “we,” “us,” or “our”). These Terms govern your access to and use of the Manga Translator mobile application, websites, and any other online products and services we provide (collectively, the “Services”).

By creating an account, downloading the app, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

1. Eligibility and Account Registration

  • Eligibility: To use our Services, you must be at least 13 years old. If you are under the age required by the laws of your country to form a binding contract, you must have obtained verifiable consent from your parent or legal guardian. Certain Services may have a higher age requirement of 18 or older.
  • Account Creation: To access certain features, you must create a Manga Translator account (“Account”). You agree to provide accurate, current, and complete information during the registration process.
  • Account Responsibility: You are solely responsible for all activities that occur under your Account and for maintaining the confidentiality and security of your password. You must notify us immediately of any unauthorized use of your Account.
  • Account Transfer: You may not license, sell, or transfer your Account without our prior written approval.

2. License to Use Our Services

  • Limited License: Manga Translator grants you a personal, non-transferable, non-exclusive, revocable, and limited license to access and use the Services for your own personal, non-commercial use, strictly in accordance with these Terms.
  • Restrictions and Prohibited Conduct: Your license to use the Services is conditional on your compliance with these Terms. You agree that you will not:
    • License, sell, transfer, distribute, or otherwise commercially exploit the Services or its content.
    • Modify, disassemble, decompile, reverse engineer, or create derivative works of the Services or its source code.
    • Access the Services in order to build a similar or competitive website, product, or service.
    • Use the Services for any unlawful purpose or in any manner that violates any applicable local, state, national, or international law.
    • Upload, transmit, or distribute any computer viruses, worms, or any software intended to damage or alter a computer system or data.
    • Interfere with, disrupt, or create an undue burden on servers or networks connected to the Services.
    • Attempt to gain unauthorized access to the Services, other users’ Accounts, or computer systems or networks connected to the Services.
    • Compromise the security of your device or the Services, for example, by jailbreaking or rooting your phone.

3. Intellectual Property Rights

Excluding any User Content (defined below), you acknowledge that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets in the Services and its content, are owned by Manga Translator. The provision of the Services does not transfer to you or any third party any rights, title, or interest in or to such intellectual property rights.

4. User-Generated Content

  • Your Content: Some areas of the Service may allow you to post content such as comments, text, or other materials (“User Content”). You retain full ownership of your User Content.
  • License Grant to Manga Translator: By creating, posting, or sharing your User Content on or through the Services, you grant Manga Translator a worldwide, non-exclusive, royalty-free, transferable license to use, host, display, reproduce, modify, adapt, and distribute your User Content solely for the purposes of operating, developing, providing, and improving the Services.
  • Responsibility: You are solely responsible for your User Content and you represent and warrant that your User Content does not violate any third-party rights or any applicable laws. Manga Translator takes no responsibility and assumes no liability for any User Content.

5. Paid Services and Subscriptions

Certain services, such as the Manga Translator Subscription, are available for purchase (“Paid Services”). By purchasing Paid Services, you agree to our Fulfillment & Operations Policy and the following:

  • Recurring Payments: You authorize Manga Translator to charge your chosen payment method at the recurring intervals you have agreed to.
  • Automatic Renewal: Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current billing period.
  • Cancellation: You may cancel your subscription at any time. The cancellation will take effect at the end of the current billing period. No refunds will be provided for any unused portion of the subscription term.

6. Termination

You may terminate these Terms at any time by deleting your Account and ceasing all use of the Services. We may suspend or terminate your Account or ability to access the Services at any time, for any or no reason, including for a violation of these Terms.

  • Survival: Upon termination of these Terms, the following sections will remain in effect: Section 3 (Intellectual Property Rights), Section 4 (User-Generated Content), Section 7 (Indemnification), Section 8 (Disclaimer of Warranties), Section 9 (Limitation of Liability), Section 10 (Governing Law and Venue), and this Section 6 (Termination).

7. Indemnification

You agree to defend, indemnify, and hold harmless Manga Translator, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MANGAOT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MANGAOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICES. IN NO EVENT SHALL MANGAOT’S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID MANGAOT, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

10. Governing Law and Venue

These Terms shall be governed by the laws of the State of California, without regard to its conflict of laws principles. All disputes related to these Terms or the Services will be brought solely in the federal or state courts located in San Francisco, California, and you consent to personal jurisdiction in these courts.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make changes, we will post the revised Terms and update the “Last Updated” date at the top. Your continued use of the Services after the changes become effective will constitute your acceptance of the revised Terms.

12. Miscellaneous

These Terms constitute the entire agreement between you and Manga Translator regarding the use of the Services. Our failure to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the other provisions will remain in full force and effect. We may freely assign our rights and obligations under these Terms.
